FOIL considers that the appropriate success fee caps should be determined in the context of a full understanding of the total remuneration presently available to pursuers’ solicitors. In a successful action a pursuer’s solicitor will almost always receive judicial expenses. These expenses are assessed by application of block fees for each stage of litigation/item of procedure or alternatively by application of a fixed rate for time spent on the case. It should be remembered that, for work carried out on or after 24 September 2018, these fees have been increased, across the board, by around 5%.
