Response to Law Commissions’ consultation on automated vehicles

Whilst FOIL agrees with the analysis of the Law Commissions that the provisions in the Act for determining contributory negligence are complex, it does not believe that it is appropriate at this stage in the development of automated technology to undertake a revision of the law on contributory negligence in this area. Until the capabilities of the technology are fully understood, to amend or refine the law would risk any proposals being out of date by the time they became relevant.
