This order, made on 15th September 2020, will come into force on 6th October 2020. It relates to the damages that may be awarded in respect of a claim for bereavement under S1A of the Fatal Accident Act 1976 (the Act) and it applies only to causes of action which accrue on or after 6 October. The amendment to the Act reflects the Court of Appeal ruling in the case of Jacqueline Smith v Lancashire Teaching Hospitals NHS Foundation Trust and others.
