It has been a long time coming. Having recommended fixed costs on the Fast Track and the lower reaches of the Multi Track in his Final Report on Civil Costs in 2009, Lord Justice Jackson’s recommendations remained a job half-done, with fixed costs applicable only to parts of the Fast Track and higher value Intellectual Property cases. In July 2017 he published a supplemental report containing his recommendations on extending fixed recoverable costs. The MOJ is now consulting on those recommendations.
