It is likely to be the case that many of the defendant representatives who have been active in responding to past consultations on the setting of the discount rate will be in a similar position, with no or little access to relevant information, as it rests predominantly in the hands of claimant representatives, both legal and financial. In drawing conclusions, the MOJ is asked to bear in mind the one-sided nature of the evidence likely to be put forward in responses to this consultation.
